Tonny Otieno Ngesa, a Kenya Defense Forces soldier accused of murdering DJ Goodie, also known as Salim Moriasi, in Kilifi on Christmas Day last year, has been ordered to undergo a mental evaluation by Malindi Senior Magistrate Onalo Olga.
This comes after the victim’s family complained about a delay in justice, claiming that police officers were protecting the accused by delaying prosecution after attempting to settle the case out of court.
The incident is said to have happened around 1:00 a.m. when the officer confronted the DJ about a song and got into an argument that led to his death at the County Lux Comfort Hotel in Mariakani, where the Director of prosecution (DPP) stated that the accused be charged with murder.
The Magistrate also ordered that Mr. Ngesa be remanded at the Mariakani Police Station while they await the results of the tests conducted by the psychiatrist before making a ruling where is expected to make a plea on March 29.
The arrest was made on Monday, according to Daniel Muleli, County Criminal Investigation for Kilifi County, after military officers presented the accused to the Director of Criminal Investigation on the same day and took the matter to court because his file was ready.
“We received the accused from the military officer, the file was prepared, and there was no time to spend, so we went to court,” Said, Mr. Muleli.
