A charge of intentionally withholding payment delivered incorrectly in violation of section 35 of the Computer Misuse and Cybercrime Act of 2018 has been brought against Ms. Jane Wanjiru Nyamu, an M-Pesa agent operator who allegedly failed to return Ksh 400,000 sent to her agent by a private company.

The prosecution claims that the company’s employee typed the wrong digits while transferring the payment, and that’s how the funds were transferred to Ms. Nyamu’s account. she had turned off her phone when they attempted to contact her.

According to reports, a representative of the company visited her shop in the Central Business District but was unable to speak with her since she had closed it and efforts to trace her had been fruitless.

With no trace of her, they took the initiative to report the matter to Kariobangi Police Station, where the police tracked her down and apprehended her. She was brought before Makadara Law Courts’ Principal Magistrate Hellen Okwani, where she denied the charges.

She was freed on a Ksh 200,000 cash bail, and the hearing will begin on August 24 this year after the case is mentioned on May 31.
